Co-Working + Play Supervision Consent Form 

At Everland, I agree to: 

1. Show kindness and understanding to all within our community.
2. Help maintain cleanliness of our space by cleaning up after myself.
3. Stay home if I or my child are feeling sick to protect our whole community.

Co-Working Rules 

1. Please arrive at your designated desk no earlier than 5 minutes before your scheduled start time, and leave your desk no later than 5 minutes after your scheduled end time.
2. Please wipe down your desk before leaving so that it’s clean for the next person who may use it.
3. Please leave the workspace as you found it. Outside food and drink is welcome at Everland, but please clean any food or drink-related messes up right away.
4. Unless you are the only person using the workspace, please refrain from engaging in phone calls or virtual meetings, and use headphones to listen to audio.

Play Space Rules 

1. Everland’s play area is shoe-free. Please prepare your child(ren) to play in socks or bare feet, except in cases where footwear is medically necessary.
2. Before play, please remove all hood and neck drawstrings from children’s clothing.
3. If a child injures another child, please note that this child must be removed from the play space immediately and may not return to the play space until the behavior has been resolved.
4. Caregivers must accompany their children to the bathroom. Our bathroom is shared with other tenants on the first floor of our building.
5. Diaper changes must be done in the back room in the designated changing area. Dirty diapers should be carried out, in the bags provided.
6. Everland is not responsible for lost, stolen or damaged belongings.
7. Children must sit in one spot while eating and drinking. We do not allow children to walk around with food and drink.
8. At the supervisor’s discretion, parents will be notified of any issues that may arise with their child(ren) and will be asked to intervene to maintain safety and well-being for all in the space.

WAIVER 

I understand that the use of any child play facility inherently entails risk. Accordingly and in consideration of Everland granting access to myself and my children (the “children”) to Everland’s play area and the equipment and other amenities and other ancillary items located in the area (collectively, the “area”), I expressly agree and contract, on behalf of myself and the

children and each of our respective heirs, executors, personal representatives, administrators, successors and assigns, that neither Everland nor its insurers, members, employees, officers, directors, or associates shall be liable for any injuries (including illness and death), damages (both economic and non-economic), and/or losses of any type sustained by me or the children on or about the facility except to the extent that the same results from the gross negligence or intentional misconduct of Everland. By signing this agreement, I hereby fully and forever release and discharge Everland, its insurers, members, employees, officers, directors, and associates, from any and all claims, damages, demands, rights of action, causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out of the use of the facility except to the extent that the same results from the gross negligence or intentional misconduct of Everland.

Further, I hereby acknowledge and agree that: I received a copy of and agree to strictly comply (and cause my children to comply) with all Everland’s rules and regulations for using the facility. I further agree to conduct myself (and cause my children to conduct themselves) in a controlled

and reasonable manner at all times and refrain from using any equipment in a manner inconsistent with its intended design and purpose. I agree that Everland may revoke or terminate my use of the area at any time if I or my children violate any of its rules, regulations, or policies. I agree to ensure that my child takes off all potentially unsafe clothing items including, but not limited to, hood and/or neck drawstrings before playing. To the best of my ability, I will support the well-being of other children that my children directly interact with. I understand and agree that Everland is not responsible for any property that is lost, stolen, or damaged while in, on, or about the area.

I represent and warrant that both I and the children are in good health and maintain the skills and physical ability to properly and safely use the area and that Everland has not and will not perform any type of screening to verify the foregoing. I hereby waive any protections afforded by any statute or law in any jurisdiction whose purpose and/or effect is to provide that this waiver is invalid, limited or inapplicable and therefore I am releasing unknown future claims. Notwithstanding the above, if any claim is allowed for any reason I agree that my sole remedy is to enter into mutually binding arbitration in Pennsylvania where each party shall agree to select an arbitrator of their choosing and they will in turn agree on a neutral arbitrator in accordance with standard arbitration procedures. I hereby consent to receive, and consent to the receipt by the children of emergency first aid which may be deemed advisable in the event of injury, accident, and/or illness related to the activities at the facility. If emergency first aid is rendered, I understand that I am waiving any and all claims resulting from the first aid and all the terms and provisions of this agreement remain in full force and effect under those circumstances.

PHOTO/VIDEO RELEASE 

I hereby give permission to Everland to use any photos or video material taken of myself or my child(ren) in the facility. I may withdraw permission for photos or video footage of me and my child(ren) to be used by Everland by emailing info@shopeverland.com.
