At Everland, I agree to: 

1. stay with and monitor my child(ren) at all times, to help them navigate the play space safely, address social interactions and attend to their emotional and behavioral well-being.

2. respect and welcome all families.

3. show kindness and understanding to all visitors and staff.

4. help maintain the space by cleaning up after my child to the best of my ability.

Everland rules: 

1. Everland’s play area is shoe-free. Please wear socks or play in bare feet.

2. Outside food and drink is welcome at Everland. Please clean any food or drink-related messes up or alert Everland staff so the play area can be kept clean for all to enjoy. Please sit in one spot while eating and drinking. Do not allow children to walk around with food and drink.

3. Please stay home if you or your child are feeling sick to protect our whole community.

4. Children are never permitted to throw objects in Everland’s play area. It is the caregiver’s job to ensure this rule is followed.

5. Caregivers are required to assist their children in play. Play items that are out of children’s reach should be provided to children by their caregivers.

6. Caregivers must accompany their children to the bathroom at all times. Our bathroom is shared with other tenants on the first floor of our building.

7. Before play, please remove all hood and neck drawstrings from children’s clothing.

8. Everland is not responsible for lost, stolen or damaged belongings.

WAIVER 

I understand that the use of any child play facility inherently entails risk. Accordingly and in consideration of Everland granting access to myself and the children identified on the list below (the “children”) to Everland’s play area and the equipment and other amenities and other ancillary items located in the area (collectively, the “area”), I expressly agree and contract, on behalf of myself and the children and each of our respective heirs, executors, personal representatives, administrators, successors and assigns, that neither Everland nor its insurers, members, employees, officers, directors, or associates shall be liable for any injuries (including illness and death), damages (both economic and non-economic), and/or losses of any type sustained by me or the children on or about the facility except to the extent that the same results from the gross negligence or intentional misconduct of Everland. By signing this agreement, I hereby fully and forever release and discharge Everland, its insurers, members, employees, officers, directors, and associates, from any and all claims, damages, demands, rights of action, causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out of the use of the facility except to the extent that the same results from the gross negligence or intentional misconduct of Everland.

Further, I hereby acknowledge and agree that: I received a copy of and agree to strictly comply (and cause my children to comply) with all Everland’s rules and regulations for using the facility. I further agree to conduct myself (and cause my children to conduct themselves) in a controlled and reasonable manner at all times and refrain from using any equipment in a manner inconsistent with its intended design and purpose. I agree that Everland may revoke or terminate my use of the area at any time if I or my children violate any of its rules, regulations, or policies. I acknowledge that Everland will not supervise my children in the area and that I am solely responsible for doing so. I agree to ensure that my child takes off all potentially unsafe clothing items including, but not limited to, hood and/ or neck drawstrings before playing. I agree to be solely responsible for the safety and well-being of my children and myself. I understand that Everland does not provide any supervision, instruction, assistance or screening for using of the area. I understand and agree that Everland is not responsible for any property that is lost, stolen, or damaged while in, on, or about the area.

I represent and warrant that both I and the children are in good health and maintain the skills and physical ability to properly and safely use the area and that Everland has not and will not perform any type of screening to verify the foregoing. I hereby waive any protections afforded by any statute or law in any jurisdiction whose purpose and/or effect is to provide that this waiver is invalid, limited or inapplicable and therefore I am releasing unknown future claims. Notwithstanding the above, if any claim is allowed for any reason I agree that my sole remedy is to enter into mutually binding arbitration in Pennsylvania where each party shall agree to select an arbitrator of their choosing and they will in turn agree on a neutral arbitrator in accordance with standard arbitration procedures. I hereby consent to receive, and consent to the receipt by the children of emergency first aid which may be deemed advisable in the event of injury, accident, and/or illness related to the activities at the facility. If emergency first aid is rendered, I understand that I am waiving any and all claims resulting from the first aid and all the terms and provisions of this agreement remain in full force and effect under those circumstances. I hereby give permission to Everland to use any photos or video material taken of myself or my child/children in the facility. I may at any time withdraw permission for photos or video footage of me and my child/children to be used by Everland.
